Sweeping US financial reform passed by Senate
The US Senate has given final approval to the biggest overhaul of American financial regulation in decades. The reforms are intended to avert a repeat of the 2008 crisis that brought the world economy to the brink of collapse. Speaking afterwards, Obama said the new regulation would give the strongest consumer protection in history. He said the American people would never again be asked to foot the bill for Wall Street's mistakes. The reforms are designed to reduce the risks that banks take and to boost protection for consumers. They include new government powers to break up any company that becomes so big its failure could threaten the economy. Moments after the vote, Federal Reserve chairman Ben Bernanke said: "The financial reform legislation approved by the Congress today represents a welcome and far-reaching step toward preventing a replay of the recent financial crisis."
American pessimism
One of the defining qualities of Americans must be their optimism. To Europeans, it can sometimes appear to be an overly cheerful enthusiasm or a willful reluctance to look harsh facts in the face. Obama's election was one expression of that optimism - the audacity of hope - embodied in Bob the Builder's constructive phrase "yes, we can". But gloom appears to be the new mood in the US these days. Commentators on the left like Robert Reich warn of a double dip recession. So do commentators of the right. Those giving investment advice say they see the signs everywhere. While cooler commentators keep their heads, there's no doubt whatsoever the jitters are out there. A recent survey suggests eight out of ten of those who lost their jobs in the last couple of years still haven't found a new one. Obama is sticking to his guns, unwavering in his big picture policy prescription. He wants to refocus America, to once again become one of the world's great manufacturers and exporters - rather than just being one of the globe's biggest consumers.
This vision is how Mr Obama sees jobs coming back. In a recent speech he said, "This is where American jobs will be tomorrow. Ninety-five percent of the world's customers and fastest growing markets are beyond our borders. So if we want to find new growth streams, we've got to better compete for those customers - because other nations are. As I have said many times, the United States of America should not, cannot, and will not play for second place. We mean to compete for those jobs - and we mean to win." While this may be excellent analysis of the problem, the difficulty is the policy prescriptions - such as more free trade and a rebalancing of the Chinese currency - hardly go to the heart of the matter. The heart of the matter being that America doesn't make enough of the goods the world wants to buy.
Federal Revenue issues new list of tax havens
The Federal Revenue of Brazil recently issued a new list of countries deemed by Brazilian tax authorities to provide favorable taxation and privileged tax regimes. Transactions carried-out with tax havens and entities under privileged tax regimes are subject to a series of restrictions and a 25% withholding tax. AgBank share trading gets off to a slow start
Agricultural Bank of China branch Investors are wary about the state bank's ability to modernize. Shares in the AgBank ended their first day of trading almost flat. They had been expected to gain as much as 5%.The bank could still be on target to raise a record $22bn in the initial public offering (IPO). But this will not be clear until the second portion of the shares begin trading in Hong Kong on Friday.
Emotion and logic play important, yet different, roles

I upgraded my computer and installed a faster processor because
-- I can save and retrieve information faster,
-- I can save time each day, even if it's only a few minutes,
-- I can run more sophisticated software, and
-- I can back up my computer faster than before.
These are good, solid, practical, logical reasons that justify why I upgraded my processor. But are they the real reasons I bought a new processor?
Of course not.
I upgraded my processor because I wanted a faster computer. Like any teenage boy with a car -- and many adult males, too No matter how fast my computer can go, I want it to go faster.
I see TV commercials for the latest and fastest chips. I see ads for the fastest operating systems.
Then I tell myself: "Wait. My computer's too slow. Someone else can download web sites faster than I can. My time's important. I have to keep up. I need a faster processor." And so on....
It's all about how advertisers push my emotional buttons. And they do.
Here's the point: You can dramatically improve your marketing results by understanding why clients hire your services.
Here's the marketing principle: Prospects hire your services for emotional reasons. They justify their decision to other people with logical reasons.
I have a friend who recently bought a Mercedes. He drones on about the anti lock braking system and many safety features
I ask, "Why a Mercedes? Why didn't you buy a Volvo? They're well known for safety features." He gives me more and more reasons why. He has mastered the art of justification.
What's the real reason he bought a Mercedes?
Because he wanted to own a prestigious car and join the exclusive group of people who drive a Mercedes
The ad agency that markets Mercedes Benz knows why people buy their cars. So, in addition to marketing prestige, they focus on the reasons people use to justify their purchase. Their ads focus on the smooth drive and technical features that separate their car from all others. But, in truth, many of those features can be found on cheaper cars. Mercedes sells cars based on emotional appeals and then justifies the purchase in its advertising by appealing to logic.
In addition to emotional appeals, you can choose emotional words. What do you feel when I say...
Scottsdale. Fraud. Party. Terrorist.
Do you see how each word arouses a different and sometimes strong feeling?
Scottsdale may bring to mind upscale, affluent, golf, sunshine, resort. Fraud makes me think of underhanded and dishonest. Party might make you think of happy, fun, enjoyable, social. And terrorist brings to mind the worst negative images.
Read these two paragraphs and see how much more emotional one sounds than the other.
Dear Client: Thank you for hiring the law firm of Smith & Jones to represent you. We realize that you could have chosen many other law firms in our city. The fact that you selected our firm is appreciated by our lawyers and staff. Thank you very much. Sincerely, Mr. Smith.
Compare it with this:
Dear Mr. Simpson: I offer my personal thanks for hiring our law firm. I just met with our firm's founder and we discussed the many ways we can serve you. I know you could have chosen a number of law firms, and I'm most grateful that you chose us. I guarantee we'll work hard to provide you with the high level of personal service that you want and deserve. Cordially, Mr. Jones.
Both letters serve the same purpose. But the second letter is far more personal. You feel as though Mr. Jones is writing specifically to you. The second letter comes across as more down to earth, filled with genuine emotion.
On the other hand, the first letter seems like a form letter that the law firm sends to all its new clients. As a result, it lacks the personal feeling and warmth.
If you hired this law firm, which letter would you rather receive?
When I write copy, I use bonding words to draw the reader closer to the author with the hope of starting or building a relationship. Words like welcome, invite, share, together, let's, help, discuss, happy, glad and so forth.
Here are a few emotional reasons prospects hire you:
They like you. They trust you. They believe you. They respect you. They appreciate your willingness to help them. You make them feel important. They share your interests outside your law practice. They value your community activities. They value your charitable work. They share your social, political, spiritual beliefs.
Here are logical reasons prospects use to justify their decision to hire you:
You have specialized knowledge. You have in depth experience. You have a high level of skill. You have a good reputation. You have a proven track record. You graduated from a prestigious law school. You have held respected positions in lawyer groups.
Bottom Line: Create your marketing message so you connect emotionally with prospects and so prospects have logical reasons they can use to justify their decision to hire you. When your marketing message contains both emotional and logical appeals, you shift your marketing program into overdrive and greatly improve your marketing results.

Argentine Senate backs bill legalizing gay marriage
Argentina has become the first country in Latin America to legalize gay marriage after the Senate voted in favor. The country's Chamber of Deputies had already approved the legislation. The vote in the Senate, which backed the bill by just six votes, came after 14 hours of at times heated debate. The law, which also allows same-sex couples to adopt, had met with fierce opposition from the Catholic Church and other religious groups.
BP says oil has stopped leakingRobots work on well
BP says it has temporarily stopped oil flowing into the Gulf of Mexico from its leaking well for the first time since 20 April.
Goldman Sachs agrees record $550m fine
Goldman Sachs has agreed to pay $550m to settle civil fraud charges of misleading investors. The charges concerned Goldman's marketing of mortgage investments as the US housing market faltered. US finance watchdog the Securities and Exchange Commission said it was the biggest fine for a bank in its history. Terms of the settlement are subject to approval by a federal judge. The SEC said Goldman had acknowledged that marketing material contained "incomplete information". In a statement, Goldman did not admit legal wrongdoing but said the move was "the right outcome for our firm, our shareholders and our clients".
Lula seeks legal ban on smacking
Lula has sent a bill to Congress which would ban the use of corporal punishment on children. The bill would outlaw any cruel or degrading treatment that humiliates or seriously threatens children, including spanking. Lula said it was not meant to prevent parents educating their children. But he said everyone knew that spanking didn't educate children any better than talking to them. Under current legislation in Brazil, child abuse is illegal, but the proposed law would for the first time explicitly ban spanking and smacking by parents and guardians. Parents who ignored the law would be given a warning, and repeat offenders could be ordered to attend child protection classes, or even undergo psychiatric treatment. Ultimately, Brazil's child protection services would intervene in households where the problem persisted. (Click here)
US military hands over last detention centre in Iraq
The US military has handed over control of its last remaining detention centre in Iraq, as it increases the pace of its withdrawal from the country. The Iraqi authorities have taken charge of 1,600 of the 1,800 detainees at Camp Cropper, near Baghdad's airport.
Chavez orders review of Vatican ties
Chavez has ordered a review of Venezuela's ties with the Vatican amid tensions between his government and the country's bishops. An accord with the Vatican gave privileges to the Catholic Church not enjoyed by other churches, he said. The Venezuelan Episcopal Conference warned this week about growing political polarisation ahead of key legislative elections in September. Chavez has described local Catholic leaders as "troglodytes".
Vatican 'speeds up' abuse cases
The Vatican has issued new instructions to speed up the handling of the "most urgent" cases of sex abuse by priests, after a series of abuse scandals, but victims groups say the new rules do not go far not enough. The rules contain "more rapid procedures", it said. Priests who sexually abuse a mentally ill adult will now be treated in the same way as those who abuse minors. The rules also extend the time in which the Church can take action against anyone who abused a minor from 10 to 20 years after a victim's 18th birthday. The new 20-year limit will continue to be extended on a case-by-case basis, the Vatican said. Existing Vatican guidance to bishops that they should report sexual abusers to civil authorities remain in effect. The Vatican said the rules were part of Church law and thus "exclusively concern the Church", while compliance with civil law was dealt with in guidelines published in April. The Church's internal justice system for dealing with abuse allegations has come under attack because of claims by victims that their accusations were long ignored. What is new is the classification of any attempt to ordain women as priests as "an extremely serious crime against Church law". The Pope has decided to crack down on the small groups of Catholic women in various countries who have been pressing for their right to be ordained to the priesthood. The new norms also formally rule that child pornography is a crime against Church law. Reacting to the news, the US-based Survivors Network for those Abused by Priests (SNAP) said the new guidelines were "like attacking at an elephant with a pea-shooter when the elephant is almost out of range".

J&J laying off hundreds to fix problems at plant
The factory in Trenton, N.J., has been idled over repeated recalls of Tylenol and other popular nonprescription medicines. About 300 of the 400 positions at the factory will be eliminated while it is out of service for what Johnson & Johnson is calling "a protracted period of time."
N.Y. lawyer gets 10-year term in terrorism case
A 70-year-old civil rights lawyer was sentenced Thursday to 10 years in prison in a terrorism case by a judge who boosted her original sentence by nearly eight years after concluding she lied to a jury and lacked remorse.
Chile plans new law to govern funds
Chilean Finance Minister Felipe Larrain said on Thursday the government plans to send a new law to Congress that governs different types of financial funds to simplify the legal framework. Chilean law recognizes five different fund types: investment funds, mutual funds, funds for the investment of foreign capital, funds for the investment of foreign venture capital and funds for home savings purposes. The project seeks the creation of a new legal framework, simplified and symmetric to be applicable to all types of funds. Each type of fund is currently regulated by different laws. The project seeks to standardize the regulatory framework by the first quarter of 2011.
Madoff-suit ruling favors J.P. Morgan
A judge dismissed a lawsuit against J.P. Morgan Chase that claimed the bank knew about a fraud committed by Bernard Madoff but continued to provide his company banking services to perpetuate the scheme.
ICTR defense lawyer shot dead
A senior defense lawyer at the International Criminal Tribunal for Rwanda (ICTR) was shot dead outside of his home Tuesday night. Police say Jwani Mwaikusa was killed, along with his nephew and neighbor, and that the attackers then ransacked Mwaikusa's car, taking a briefcase and some documents. Mwaikusa worked as a defense counsel for former businessman Yussuf Munyakazi, who was convicted earlier this month on charges of genocide and extermination as a crime against humanity. Rwandan authorities had sought to have Munyakazi transferred to Rwanda for trial, but that request and the subsequent appeal were both denied based on Mwaikusa's argument that his client couldn't get a fair trial there, because the judiciary in Rwanda may not be fully independent and immune from outside pressure. Democratic fundraiser sentenced to 12 years for Ponzi scheme
Former Democratic Party fundraiser Hassan Nemazee was sentenced Thursday to 12 years in prison after pleading guilty in March to charges of bank fraud and wire fraud relating to his orchestration of $292 million pyramid scheme. The federal judge for the US District Court for the Southern District of New York also ordered Nemazee to pay $292 million in restitution to the banks that were the targets of the fraud. Nemazee spoke prior to the sentencing, stating that he takes responsibility for his crimes and blaming his conduct on pride and arrogance.
Gambia court sentences 8 to death for roles in 2009 coup attempt
A Gambian court on Thursday sentenced eight men—six former army officers and two former high-ranking government officials—to death for their roles in a 2009 coup attempt. The men were charged in March with conspiring to overthrow the government of President Yahya Jammeh. The men were found guilty of treason after the prosecution was able to sufficiently show that they had obtained arms and troops from Guinea in order to oust the government.
Nine states file amicus brief supporting Arizona immigration law
Michigan Attorney General Mike Cox filed an amicus curiae brief Wednesday on behalf of nine states in support of Arizona in a lawsuit filed earlier this month by the US Department of Justice (DOJ), seeking to permanently enjoin Arizona's controversial immigration law. The DOJ's complaint claims that the law is preempted by federal law and therefore violates the Supremacy Clause of the US Constitution. In their amicus brief, the states contend SB 1070 is not preempted by federal law unless the statute consists of a regulation of immigration or unless it conflicts with federal law so that the objective of the federal law cannot be achieved as intended by Congress. The states argue that SB 1070 does not constitute a regulation of immigration and that it does not conflict with, but rather supports federal immigration law. The states also maintain that Congress intended for there to be cooperative enforcement of immigration laws and that the DOJ seeks to supplant the cooperative scheme with a system where the federal government chooses which laws to enforce.
eBay sued for $3.8 billion in patent infringement case
Connecticut company XPRT Ventures LLC filed suit Tuesday against eBay in the US District Court for the District of Delaware, claiming the infringement of six patents for online auctions and payment systems. According to the complaint, which also names PayPal, Bill Me Later, Shopping.com and StubHub as defendants, XPRT alleges that eBay misappropriated information shared in confidence by the inventors of XPRT's patents and incorporated it into eBay's existing payment systems.
UN rights expert condemns proposed Italy wiretapping law
UN Special Rapporteur on freedom of expression Frank La Rue on Tuesday condemned an Italian bill that would restrict the use of wiretaps and criminalize the reporting of wiretap transcripts by the news media. La Rue urged the Italian government to either abolish or substantially revise the bill, warning that if it is adopted in its current form, it could significantly suppress freedom of expression in the country. Under the proposed legislation, a three-judge panel would be required to grant a wiretap, and the wiretap would only be valid for a two-month period. Any publication reporting on the contents of a wiretap during an ongoing investigation would be subject to fines of USD $540,000, and the individual journalist reporting the information could also be held liable. La Rue expressed concern about the penalties journalists would face under the bill and the effect it would have on investigative reports on matters of public interest like corruption
