Process of setting up branches of foreign entities in Brazil is now electronic

Enrique Tello Hadad and Fernanda Nakada

On April 15, the Normative Instruction 59, of the Department of Commercial Register and Integration - DREI, was published, simplifying the procedure related to the opening of a branch, office, agency or establishment of foreign entities in Brazil.

The referred rule, which amended the Normative Instruction DREI 7/13, establishes that, from now on, the entire governmental authorization process for the incorporation of a branch of foreign entity in Brazil will be electronic, from the request thru the authorization, by means of an electronic portal of the Brazilian government.

Prior to this rule, the filing of the documents was carried out either directly at the Department of Commercial Register and Integration - DREI or by courier.

The new rule aims at reducing the bureaucracy and, consequently, the time required for the process of setting up branches of foreign entities in the Brazil.
